Actually they might... that data is being questioned/appealed.
A friend/colleague of mine who's a physiology professor at CU just spent a week in Switzerland testifying as an expert witness for Pistorious in front of the olympic committee. He believes there were significant errors made in the energy use / return projections and that the advantages of the Cheetahs, if any, are miniscule.
He thinks it'll be overturned - but we'll see... it seems pretty political. Either way - even if it's overturned and he's allowed to race it's unlikely he'll qualify for Beijing, as his appeal has kept him from training enough and I don't even believe his PR would be fast enough to qualify... but maybe for 2012?
On a side note - I think it's pretty ironic that the name of his prosthetics rhymes with "cheater" (especially with a Boston accent) :lol:

You're right... it has been overturned - I wasn't paying enough attention I guess.

There are many factors, but personally I can see both sides of the argument. For me, it would be tough to figure out who is right b/c both seem to have valid points.
